|Making A Purchase Making A Purchase Making a purchase could not be easier. Just browse our store, and add any items that you wish to buy into the shopping cart. After you have finished your selection, click on 'Checkout' (at the top of the page) and you will be asked for a few details that we need to be able to complete the order. It may not be possible to order certain personalised items online for these items please contact us by telephone or email.|
Payment in full is due when placing an order. If you order online you may select to pay online by credit / debit card via the secure paypal gateway. You do not need a paypal account to do this. When you have placed your order you will be directed to the Paypal payments page. If you don't have a Paypal account simply select the Pay by Card option on the left hand side of the page (ignore the section that says Log in to your Paypal account). You may also select the Telephone for card details option. If you select this option we will call you for payment details OR if you prefer you can call us. When paying by credit / debit card please enter your address as the address to where your card is registered to. Your card may be declined if you do not provide us with this address.
For all orders placed overseas payment by bank transfer is the only payment method accepted.
When confirmation of order is received, this is to indicate that we have received your order. It does not indicate that a contract exists between us. We will indicate acceptance of your order, when we send you an invoice. We have included this term to protect us in the case that a mistake has been made in pricing, we have inadvertently under-priced goods, or we are no longer able to supply a particular product for some reason. In the case of a change of price, we will always contact you first to ensure that the price is acceptable.
|Shipping And Handling Shipping is charged by weight of the parcel. We will despatch your order to the delivery address as requested when placing your order. You can choose to have your chocolates delivered by post or by a courier.|
We will take all reasonable steps to deliver your order within the time indicated. However, we will not be under any liability to you in respect of any failure to deliver within this timescale or on any particular day or dates.Customers who use our Courier Delivery service MUST provide a delivery address where the order can be accepted and signed for. i.e. your home, a neighbour or your workplace.
There are several days each year that we cannot despatch chocolate orders due to extremes of temperature. (over 28 degrees) and extremes of weather. These are circumstances byond our control & we will not be under any liability to you in respect of failure deliver within this timescale or on any particular day or dates.
If you choose to have your parcel despatched using a post office service we cannot guarantee the post office service.
Missing or lost in the post standard royalmail delivery:
Due to changes in the Royal Mail procedure it is not possible for us to claim for lost or damaged parcels. If you feel your order has been lost in the post you must e-mail firstname.lastname@example.org stating that your order has been lost in the post and please include your order number. We will then send you the proof of posting document by Recorded Delivery to the delivery address on the order so a claim can be made by the purchaser. This is Royal Mail policy and not our own. If you have a time sensitive order (eg a birthday present) please choose to have the courier deliver your parcel as they will deliver the parcel the day after it has been despatched (excluding weekends)
If you are not there to sign for your parcel the courier will leave a calling card. You will need to ring the number on that card to re-schedule delivery. If you do not call the courier within 3 days the courier will return the parcel to Hames Chocolates Ltd. The courier will charge us to bring the parcel back to our despatch centre, we have to pass this charge to our customer. The cost of failed delivery is a minimum of £15.99 plus a redelivery charge (this charge is the couriers policy).
PLEASE ensure that you have your parcel delivered to an address where someone will be available to sign for it. This can be a work address.
PLEASE ensure that you have given the correct address and postcode.
Where the delivery is aborted because there is no one at the delivery address a charge of £15 will be made to cover the costs invoiced to us by the courier this happens only in extreme cases where the courier has tried to deliver more than once.
In the event that you are expecting a parcel that has not yet arrived or want to check its status please contact us with your consignment number and we will give you a contact number for the courier and your consignment number.

If you select to have your order delivered by courier and you are on the mainland UK they will be delivered within 24 hours of despatching them (courier does not deliver weekends, our factory does not open weekends). If you select the option of having the post office deliver your goods then we would normally despatch the goods first class.
Personalised Items: Depending on the product ordered personalised items can take from a couple of days to several weeks from order to completion of manufacture. Please contact us for further details. As a guide if you order one single personalised box of chocolates we would expect to despatch to despatch this within two working days. If you are ordering 1000 boxes of chocolates we would expect to despatch these in 2-4 weeks.
You must inform us within two working days if the goods are lost or damaged in transit so that we can make a prompt claim against the delivery company and correct the problem. Please quote your order number in all correspondence.
You agree that proof of delivery supplied by our delivery company is sufficient evidence to establish that goods have been received.

Most of our products are made to order. This gives you the longest shelf life available. Generally 12 months for chocolate bars and 9 months for filled chocolates.
Due to the manufacturing processes involved final quantities can vary +/_ 10% and you will be charged contract rate for the quantity delivered. Tools of all kinds, moulds, films, drawings and any necassary tool required for production remain our property irrespective if the purchaser contributes to the production costs. Any moulds, tools, cliches, etc required for special designs will be kept for 12 months before destroying if no re-order is received during this time.
You warrant that you are the author, licensee or assignee of all text, logos, artwork and any other materials ("Material") supplied by You to us and are authorised to supply such Material to be displayed on our products. To the extent permitted by law we hereby expressly exclude any liability where Material supplied by you infringes the intellectual property rights of any third party and any direct, indirect or consequential loss or damage incurred by any third party in connection with the display of such infringing Material on our products, including, without limitation any liability for loss of income orf revenue; loss of business; loss of profits or contracts; loss of goodwill or for any other loss or damage of any kind, however arising and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable. We are the distributor (and not a publisher) of Material supplied by You.
We reserve the right to alter any details or designs of products illustrated without notice and while every effort is made to describe goods accurately in the catalogue no warranty is given to accuracy.
We keep our website and catalogues constantly updated using updated images of our work. This may mean that your tex, logos, artwork and any other materials ("Material") provide by you to us may be photographed and included in our promotional materials. By agreeing to our terms and conditions you authorise us to use your Materials for these purposes. If you do not wish your personalised products to be photographed you must notify us in writing when placing your order or within 7 days from placing an order with us.
